Learned counsel for the applicant submits that the applicant is named in the F.I.R. with the allegation that on the alleged date the applicant enticed her away and took at Moradabad where he committed her rape and also made video clip of the alleged incident, thereafter, he committed rape again. In her statements recorded under Section 180 & 183 B.N.S.S. she has reiterated the version of F.I.R. with some contradictions. Learned counsel further submits that as per the prosecution the first incident took place on 03.07.2025 and last incident took place on 10.08.2025, whereas the F.I.R. has been lodged on 20.08.2025, without there being any plausible explanation of delay and moreover the victim has not made any complaint against the applicant when first incident took place with her.
