Court No. - 65 HON'BLE DR. GAUTAM CHOWDHARY, J. 1. Heard learned counsel for the applicant, learned A.G.A for the State and perused the record. 2. Learned counsel for the applicant submits that the F.I.R., has been lodged by the victim against her husband namely, Devraj Chauhan and brother-in-law namely, Shameer and Kamar and the allegations levelled against them is that they all used to torture and abused her. He further submits that in the F.I.R., there is no whisper about allegation of rape but the victim in her statements recorded under Section 180 and 183 of B.N.S.S., has levelled allegation of rape against the applicant which itself falsifies the prosecution story. Learned counsel for the applicant has contended that on account of matrimonial discord between the victim and her in-laws, the applicant has been falsely implicated being brother-in-law (Nandoi) of the victim only to exert pressure upon the husband and his family.
