Learned counsel for the applicant has stated that the FIR was instituted against unknown persons by the informant. Subsequently, the informant nominated the applicant and other co-accused persons, five persons in all, as an afterthought in his statement recorded under Section 180 B.N.S.S. 5. Learned counsel for the applicant has further stated that the applicant is not named in the FIR.
