Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that applicant is named in the F.I.R. with the allegation that he enticed away the daughter of the informant aged about 15 years. When the victim was recovered her statement under Section 180 B.N.S.S. was recorded wherein on the alleged date she went alone and reached at Ghaziabad and she has not named the applicant, whereas in her statement recorded under Section 183 B.N.S.S. she has made specific allegation against the applicant for commission of rape.
