Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that in the F.I.R. the victim has made allegation against the applicant that entered into her house in the midnight and by threatening to kill her children he was committing her rape and when her brother-in-law and father-in-law woke up they caught the applicant but he fled away. In her statements recorded under Section 180 & 183 B.N.S.S. the victim has reiterated the same version of the F.I.R. Learned counsel further submits that the victim has denied for her internal medical examination.
