The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant, Kadir with a prayer to release him on bail in Case Crime No. 189 of 2025, under Section 8/22/29 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station- Chilkana , District- Saharanpur. Learned counsel for the applicant has contended that applicant was not arrested from the spot. His name surfaced on record on the basis of confessional statement of co-accused. As per prosecution version, allegation of selling intoxicating capsules to the co-accused Wasim, who were nabbed from the spot, have been levelled against the applicant.
