Learned counsel for the applicant submits that though in the F.I.R. as well as in the statements of victim recorded under Section161 & 164 Cr.P.C. there is specific allegation of rape against the applicant, but at the trial the victim deposed her evidence as P.W.1. and in her cross- examination she has not supported the prosecution case, which statement is annexed as Annexure No. S.A.1 to the supplementary affidavit filed today. Thus, it is argued that there is bleak chance that prosecution may prove its case beyond reasonable doubt and the applicant may be convicted.
