Learned counsel for the applicant submits that though in the F.I.R. as well as in the statements of victim recorded under Section161 & 164 Cr.P.C. there is specific allegation of rape against the applicant, but at the trial the victim deposed her evidence as P.W.1. and in her cross- examination she has not supported the prosecution case, which statement is annexed as Annexure No. S.A.1 to the supplementary affidavit filed today.
