The instant bail application has been filed on behalf of the applicant, Javed Ahmad Khan, with a prayer to release him on bail in Case Crime No. 130 of 2024, under Sections 302, 120-B of IPC, Police Station-Kalwari, District- Basti, during pendency of trial. This is the second bail application. The first bail application of applicant was rejected on the basis that the minor daughter of the deceased made allegation against the applicant of committing the murder of her mother. Learned counsel for the applicant has submitted that subsequently the child victim has been examined before the trial court, but she has not supported the allegations made against the applicant and has been declared hostile.
