Learned counsel for the applicant submits that applicant is named in the F.I.R. along with one other accused with the allegation that on the date of occurrence both these accused took his minor daughter, aged about 13 years, forcibly and tried to commit her rape and when his daughter made cry the other accused left her to her school. In her statement recorded under Section 180 & 183 B.N.S.S. the victim has made only allegation of her molestation and commission of obscene activity but she has not made any allegation of rape against both the accused.
