Heard learned counsel for the applicant, learned A.G.A. for the State as well as learned counsel for the informant and perused the record. 3. Learned counsel for the applicant submits that there is allegation against the applicant that he committed rape of the daughter of the informant, but during course of trial the victim (P.W.2) in her testimony deposed at the trial has not supported the prosecution case and she has been declared hostile, which statement has been filed as Annexure No. S.A.1 to the supplementary affidavit filed today. Thus, it is argued that there is bleak chance that prosecution may prove its case beyond reasonable doubt and the applicant may be convicted.
