Learned counsel for the applicant submits that though the victim in her statement recorded under Section 183 B.N.S.S. has made allegation of rape against the applicant, but during trial the victim appeared as P.W.1. and in her testimony she has not supported the prosecution case and has been declared hostile, which statement has been filed as Annexure No. S.A.1 to the supplementary 27.06.2025, thus, it is argued that there is bleak chance that prosecution may prove its case beyond reasonable doubt and the applicant may be convicted.
