The present suit has been filed seeking the relief of permanent injunction restraining the defendant from infringing the trademark of the plaintiff, passing off along with other ancillary reliefs. 3. Along with the present suit, the plaintiff filed I.A.10101/2018 under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure, 1908 (hereinafter ‘CPC’), seeking an ex parte ad interim injunction, restraining the defendant from using the mark ‘ALCHEM’. 4.
