Prescribed Authority/ Assistant Labour Commissioner, Agra and others, this special appeal arising out of the order passed by the writ court under Article 226 of the Constitution of India which itself arose out of the proceedings of the Labour Commissioner under the Payment of Gratuity Act, 1972, is barred by exclusionary clause contained in Chapter VIII Rule 5 of the Allahabad High Court Rules, 1952.
