This petition purportedly in public interest has been filed by the petitioner seeking a direction to respondent no. 7 to remove the factory being run in the residential house which is next to the residence of the petitioner. 2. A perusal of the petition indicates that the allegations pertain to nuisance being caused on account of the running of the machines in the adjacent house. 3. The subject matter of the present petition though has been titled as public interest, as the house in question of respondent no. 7 is situated next to that of the petitioner, it cannot be termed as a Public Interest Litigation. The petitioner has remedy under Section 152 of the Bharatiya Nagarik Suraksha Sanhita, 2023 wherein the allegations as made by the petitioner can appropriately be examined. 4.
