This petition purportedly in public interest has been filed by the petitioner seeking removal of encroachment by respondent No.6 over Gata No.90/1 & 90/5 recorded as pond in revenue records situated at Mohalla-Lakhamipur, Tehsil-Mugalsarai, District Chandauli. 2. A perusal of petition indicates that in paragraph 10, the petitioner has specifically averred that he has filed a Case No.176 under Section 38(1) of U.P. Revenue Code, 2006 ('the Code') before the Sub-Divisional Magistrate, Mugalsarai, Chandauli seeking cancellation of mutation existing in the name of respondent No.6 wherein the report has been given regarding the land in question being of pond by the revenue authorities. 3. Filing of a petition seeking removal of encroachment when admittedly the land in question s
