The instant petition has been preferred in the nature of PIL alleging that the pond land has been encroached upon by the private-respondents No.6 to 9. 3. The record would indicate that the petitioner in Para-40 of the petition has clearly stated that the District Magistrate concerned had responded to a letter issued by the petitioner indicating that the proceedings under Section 67 of the U.P. Revenue Code, 2006 (in short, 'the Code, 2006') have been initiated and appropriate action would be taken upon passing of the final orders. 4.
