This petition, purportedly in public interest, has been filed by the petitioners seeking direction to respondent no. 5, Nagar Nigam to remove the encroachment made by opposite party no. 6. 2. A perusal of the record indicates that pertaining to the disputed site, a suit filed by respondent no. 6 is pending consideration before the competent civil court wherein an interim order has been passed which appears to be in currency. 3. In view of the fact that qua the disputed site, the civil court is seized of the matter, filing of a PIL seeking some action by respondent no. 5 qua the suit land, cannot be countenanced. 4.
