The present petition has been filed by the Petitioner- Mr. Devender Singh under Articles 226 and 227 of the Constitution of India, inter alia, challenging the Order-in-Original dated 28th July 2025 (hereinafter, ‘impugned order’) passed by the Additional Commissioner, CGST Delhi West Commissionerate. A Show Cause Notice (hereinafter, ‘SCN’) dated 17th August, 2023 was issued to the Petitioner wherein the allegations were that there were 41 firms which were fraudulently availing Input Tax Credit (hereinafter, ‘ITC’) without actual receipt of goods.
