Learned counsel for the applicant submits that applicant is named in the F.I.R. with the allegation that he had enticed away the minor daughter of the informant aged about 14 years and on search she was found lying in a forest in unconscious condition and when she regained her consciousness she told him that after committing her rape the applicant had thrown her after assaulting her. In her statement recorded under Sections 180 & 183 B.N.S.S. though the victim has made specific allegation of forcible rape against the applicant but from her statements it is crystal clear that she knew the applicant from earlier.
