It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that the incident is alleged to have taken place on 02.10.2024, whereas the F.I.R., has been lodged on 27.10.2024 without there being any plausible explanation of such an inordinate delay. He further submits that the victim in her statement recorded under Section 180 of B.N.S.S., has specifically stated that the applicant, who resides adjacent to her used to bother her and she explains that he is married person, who assured that he will divorce his wife.
