Heard learned counsel for the applicant, learned A.G.A for the State and perused the record. 2. Learned counsel for the applicant has contended that in the F.I.R., allegation of rape has been levelled against the co-accused Pappu, whereas the allegation of committing maarpeet has been levelled against the applicant. Learned counsel further submits that similar allegation has been by the victim in her statement recorded under Section 180 of B.N.S.S., however, the victim in her statement recorded under Section 183 of B.N.S.S, has levelled against of rape against the applicant as well as against the co-accused-Pappu. It is thus contended that there is material contradiction in the statement of the victim and therefore the applicant is innocent and has been falsely implicated in the present case.
