GAUTAM CHOWDHARY, J. 1. Heard learned counsel for the applicant, Sri Sanjeev Kumar Tripathi, learned counsel for the informant, learned A.G.A for the State and perused the record. 2. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that the victim had gone out of her own free will and consent. Learned counsel further submitted that the victim in her statement recorded under Section 180 of BNSS has stated that she was scolded by her parents on account of which, she had gone to her maternal uncle's house, whereas the victim in her statement recorded under Section 183 of B.N.S.S., has levelled allegation of rape against the applicant.
