Heard Sri Bratendra Singh, learned counsel for the applicant and Sri Sunil Kumar, learned A.G.A for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No.601 of 2025, under Sections 103(1), 238A of B.N.S., Police Station Kotwali, District Mainpuri, during the pendency of trial. 4. Learned counsel for the applicant submits that FIR was instituted against unknown person. Subsequently, the name of applicant has come up in the statement of Sonu who happens to be nephew of the deceased person. In the said statement he stated that he had seen the applicant and deceased person before the incident. The false recovery of mobile phone has been planted on the applicant. As such, the applicant is entitled for bail. 5, It is further stated that there is no criminal history of the applicant. The applicant is languishing in jail since 01.09.2025. In
