The instant bail application under Section 483 BNSS, 2023 on behalf of the applicant Jai Prakash Dubey S/o Hariprasad Dubey, has been filed seeking enlargement on bail in Case Crime NO. 155 OF 2025, under Sections 191 (2), 191 (3), 190, 109 (1), 352, 351 (3), 329 (3), 324 (4), 61 (2) of BNS and Section 3(1) Ka/ 3 (2)(v) of SC/ST Act, Police Station- Airport, District-Prayagraj, during the pendency of trial. The bail application of the applicant before the Court below was rejected by the Additional District Judge, Court No. 14, Prayagraj, vide order dated 25.10.2025 and the applicant is incarcerated in jail since 16.09.2025. In the opinion of the Court the present bail application is not maintainable in view of Section 14 A(2) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 which reads as
