Learned counsel for the applicant submits that the F.I.R. was lodged against 12 named persons and 11 unknown with the allegation that all the accused committed rape of the informant's daughter. Neither the applicant is named in the F.I.R. nor the victim in her statements recorded under Section 180 & 183 B.N.S.S. has taken his name and she has made specific allegation against the named accused, Raj Vishwakarma, thus, main allegation is against the accused, Raj Vishwakarma. Two other co-accused, Mohd. Raza Alias Zaib and Shabbir Alam @ Sameer Ahmad, who were also named in the F.I.R, have already been enlarged on bail by this Court vide order dated 17.10.2025 and 11.11.2025 passed in Criminal Misc.
