Learned counsel for the applicant submits that applicant is named in the F.I.R. along with six other accused. In the F.I.R. it has been alleged that the applicant, who is the elder brother-in-law (Jeth) of the victim, earlier on 01.04.2024 tried to commit overt act with her and all the accused including her husband used to harass and torture her. In her statement recorded under Section 180 BNSS she has reiterated the version of F.I.R. and has not made any allegation of rape against the applicant, whereas in her statement recorded under Section 183 BNSS she has developed her case by making allegation of rape against the applicant.
