It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that the initially F.I.R., was lodged under Section 87 of BNSS alleging that the victim had gone to grocery shop but she did not return and the informant has doubt that the victim has been enticed away by the applicant. Learned counsel further argued that the victim was recovered after three days and her statement under Sect ion 180 of BNSS was recorded wherein she has stated that on 17.08.2025, the applicant took her away to market, where there is a room and had forcibly established physical relations with her.
