Court No. - 65 HON'BLE DR. GAUTAM CHOWDHARY, J. 1. Heard learned counsel for the applicant, learned A.G.A for the State and perused the record. 2. Learned counsel for the applicant has contended that the victim in her statement recorded under Section 164 Cr.P.C., has specifically stated that on one day at about 07:00 P.M. she had gone in the field to ease where the co-accused Rohit, Ajeet and Rahul pressed her mouth with clothes and committed rape, thereafter sold her to the applicant, who took her Azamgarh, thereafter Gorakhpur and had kept her for about nine months and was continuously committing the offence. Learned counsel argued that the victim had gone with the applicant and stayed with him for about nine months but she did not raise any alarm and was committing the offence, which cannot be believed by a man of ordinary prudence.
