The allegation against the applicant is that the applicant was committing wrong with mentally retarded lady. Learned counsel for the applicant has contended that the victim is major and initially the F.I.R., was lodged under Section 74 of BNSS as there was no allegation of rape levelled against the applicant. He further submits that though the allegations of rape has been levelled in the statement of the victim recorded under Section 183 of B.N.S.S., but perusal of the medical evidence, which was conducted on the next date of the incident, goes to who that the same does not corroborate with the prosecution story.
