It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that the victim is aged about 19 years and in her statement recorded under Section 183 of B.N.S.S., she has specifically stated that she was in talking terms with the applicant since last two months and when the applicant expressed his desire to marry her, she refused to marry her. On 22.07.2025 at about 01:00 hours, the applicant came from her house roof and pressed her mouth and committed rape twice upon. Learned counsel further argued that in fact, the victim is a consenting party and that the applicant had gone to meet the victim but when her grandmother had heard their voice, the victim has levelled allegation of rape aga
