Heard Shri Jainendra Kumar Pandey along with Shri Vipin Chandra Pandey, learned counsel for the applicant, Shri Ajay Kumar Singh, learned A.G.A. for the State and perused the record of the case. 2. The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant, Gulsher, with a prayer to release him on bail in Case Crime No.393 of 2025, under Section 8/21 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Nakur, District Saharanpur, during the pendency of the trial before the Court below. 3. Learned counsel for the applicant has contended that 150 gms. of contraband (smack) is alleged to have been recovered from the possession of the applicant. The recovery shown from the possession of the applicant is below commercial quantity. In fact no such recovery was effected from the applicant
