Learned counsel for the applicant has submitted that the allegation against the applicant is that he had illegally detained the victim at his house and had committed rape upon her. Learned counsel further argued that according to the F.I.R., averments, the victim was married with one Suleman, who is the cousin brother of the applicant and that Suleman used to quarrel frequently with the victim as such the applicant took her away at his house. Learned counsel further argued that the victim is the mother of five children and that in the F.I.R., no date of incident has been described.
