Court No. - 65 HON'BLE DR. GAUTAM CHOWDHARY, J. 1. Heard learned counsel for the applicant, learned A.G.A for the State and perused the record. 2. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that the victim is major and had gone with the applicant out of her own free will and consent. He further submits that the victim in her statement recorded under Section 180 B.N.S.S., has specifically stated that her father lodged the F.I.R., on the basis of suspicion whereas, the victim in her statement recorded under Section 183 B.N.S.S., she has specifically stated that she was in talking terms for the last 4-5 years and that the applicant took her away at Gujarat, where he had committed rape upon her. Learned counsel further argued that the victim had stayed with the applicant for about 1, 1/2 months without raising any alarm,
