Court No. - 65 HON'BLE DR. GAUTAM CHOWDHARY, J. 1. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material brought on record. 2. Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the present case. The F.I.R. was lodged against five persons including the applicant with the allegation that after hearing noise when informant reached at the spot he found dead body of his brother in an agricultural field. In the FIR the informant states that it came into light to him that the named accused had killed his brother. The role of having caused gunshot injury to the deceased has been assigned to the co-accused, Akshay. Learned counsel further submits that on the same set of allegation and evidence one co-accused, namely, Nitin, who was also named in the FIR has already been enlarged on bail and as the case of applicant is not on the worse footin
