Learned counsel for the applicant submits that the F.I.R. was lodged by the victim herself stating therein that she is aged about 24 years, she knew the applicant much prior to the alleged incident and was in friendship with him. On the alleged date the applicant had made a phone call to her and stated to go to the house of his brother-in-law, thereafter, she went there on her own. In her statement recorded under Section 180 B.N.S.S. has reiterated the version of F.I.R. and also developed her story that earlier the applicant had made sexual relation with her on the pretext of false promise of marriage.
