The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant, Vishal Sain with a prayer to release him on bail in Case Crime No. 274 of 2025, under Section 29 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station- Ecotech-3 Central Commissionerate, District- Gautam Budh Nagar. Learned counsel for the applicant has contended that 44.33 Kg. Ganja is alleged to have been recovered in this case. No recovery was effected from the applicant. Applicant was not apprehended from the spot. It is next contended that in the present case the prosecution has failed to follow strictly the provisions of Section 50 of the N.D.P.S. Act.
