It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. He further submits that the victim is aged about 21 years and that she had gone with the applicant at Mussorie and stayed at a Hotel out of her own free will and consent, though the victim in her statement recorded under Section 180 of B.N.S.S., has stated that the applicant had enticed her away and took to Mussorie, thereafter stayed in a hotel and against her wishes has established physical relationship.
