Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the material brought on record. 3. Learned counsel for the applicant submits that applicant is named in the F.I.R. In the F.I.R. as well as in her statement recorded under Section 180 BNSS the victim has stated that on the date of occurrence the applicant took her on a motorcycle and at a place he started committing obscene activity with her and when she slapped him and made noise he left her in her village, but in her statement recorded under Section 183 BNSS the victim has developed her case by making allegation that on the alleged date the application also committed her rape forcibly. As per high school marksheet the date of the victim is 08.09.2000, thus, she was major at the time of alleged occurrence. Learned counsel further subm
