Learned counsel for the applicant submits that though the informant/ victim in her statements has made specific allegation against the applicant for commission of rape committed upon her as well as of her minor daughter, but at the trial the informant/ victim (P.W.1) in her testimony has not made any allegation of rape against the applicant and she has not supported the prosecution case, which statement has been filed as Annexure No. S.A.1 to the supplementary affidavit dated 08.11.2025, which is on the record.
