Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 3. Learned counsel for the applicant submits that though the victim in her statements has made specific allegation against the applicant for committing her rape, but at the trial the victim (P.W.1) in her evidence has not made any allegation of rape against the applicant and such allegation has been made by her against one co-accused Shani, which statement has been annexed as Annexure-S.A.1 to the supplementary affidavit filed today. Thus, it is argued that since the victim at the trial has made specific allegation against one co-accused, Shani, therefore, there is bleak chance that prosecution may prove its case against the applicant beyond reasonable doubt and he may be convicted.
