Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. Learned counsel for the applicant submits that though the victim in her statement recorded under Section 183 BNSS has made specific allegation against the applicant for committing her rape, but at the trial the victim (P.W.1) in her testimony has not made any allegation of rape against the applicant and she has not supported the prosecution case, which statement has been filed as Annexure No. S.A.1 to the supplementary affidavit dated 28.10.2025, which is on the record. Further it has also been submitted that grandfather as well as mother of the victim have also not supported the prosecution case at the trial and they have also been declared hostile.
