In compliance with the order of this Court dated 26.09.2018, the office has submitted a report dated 17.10.2020 with reference to a report dated 1st November, 2018 submitted by the learned Chief Judicial Magistrate, Aligarh. The office report as well as the Chief Judicial Magistrate's report say that the sole appellant Tariq Ali, is no more. A perusal of the learned Chief Judicial Magistrate's report dated 01.11.2018 shows that two witnesses, who are nephews of Tariq Ali, that is to say, Abid Ahmad Khan, and Khalid Ahmed Khan and Mohd. Khurram (a neighbour) have testified to the fact that Tariq Ali died on 24.03.2018 suffering a heart attack. All these witnesses have reported the fact to the learned Chief Judicial Magistrate, who has recorded their statement duly signed by each of them.
