Through this appeal filed under Sections 96 and 151 of the Code of Civil Procedure, 1908 [hereinafter referred to as „CPC‟], the Appellant challenges the Judgment dated 07.03.2014 passed by the learned Single Judge in CS(OS) 825/2013 captioned Anuradha Bhattacharjee vs. Anu Radha, wherein the Appellant‟s suit for injunction and damages was dismissed. 2. By the said judgment, it was held that the claim for permanent injunction did not survive. For the relief of damages, the learned Single Judge, without framing issues or affording an opportunity to lead evidence, held that no cause of action had accrued to the Appellant against the Respondent for recovery of damages.
