This petition has been filed by the petitioner aggrieved of the recovery initiated pursuant to the demand dated 29.01.2025 for the assessment year 2015-16. 2. Submission has been made that the appeal was filed on 27.03.2025, which remains pending and after the issuance of the recovery certificate, the petitioner has filed application for stay on 26.05.2025 and the action of the respondent to enforce the demand during the pendency of the appeal/stay application cannot be countenanced. 3. Learned Standing Counsel made submissions that along with the appeal no stay application was filed and it is only after the issuance of the recovery certificate, the stay application has been filed. 4.
