Sri Akhilesh Pratap Singh, learned counsel for the Bank has submitted that the petitioners as a matter of fact have purchased the encumbered property for which recovery proceedings have already been initiated. That being the position, a writ of mandamus sought by the petitioners under such circumstances cannot be issued.
