Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. Learned Standing Counsel, on the basis of instructions, has submitted that no part of Gata No.809 measuring 1.680 hectares situated at Village Raghunathpur Hariharpur, Tehsil Mishrikh, District Sitapur belonging to the petitioner is encroached upon by the State for the purpose of construction of chak road. It is rather pointed out that the petitioner is in possession of some part of Gata No.834 upon which the chak road is proposed to be constructed. The encroachment by the petitioner himself upon Gata No.834 is without any authority of law for which necessary proceedings required, if any, shall be taken up and the occupation removed. 3. Once the land belong to the petitioner i.e. Gata No.809 is not interfered with by the S
