Learned counsel for the petitioner has submitted that, despite an interim order passed by the competent civil court in Regular Suit No.83 of 2021 on 23.02.2021, respondent No.3 has taken possession of the disputed property. 3. The competent civil court appears to have passed the order dated 23.02.2021 with due participation of the parties. However, it is not clear from the record as to when such an order was served upon the local police for its implementation or for the protection of the petitioner’s right. 4. Be that as it may, if respondent No. 3 has committed any contempt of the order passed by the trial court, proceedings in this regard under Order XXXIX Rule 2A of the C.P.C. are already sub judice before the court concerned.
