Petitioners, who deserve promotion from Constable to Head Constable and their candidature came to be considered by the Departmental Promotion Committee 14.12.2022 but on account of a pending criminal case, the decision in their case for promotion was put in a sealed cover adopting the seal cover procedure. It is submitted that thereafter chargesheet has been filed and case is going on before the trial court. It is stated that since petitioners are not in any manner responsible for the delay in disposing of the pending criminal trial, more than a year has already expired, their claims are liable to be considered in view of the paragraph 10 of the Government order dated 28th May, 1997. Paragraph 10 of the Government order runs as under: "(10) चयन सममिमति दद्वारद्वा प्रथमि बद्वार आररोमपिति कद्वाममिर क ककी प्ररोन्नमति पिर मविचद्वार करनने एविवं मिमुहर बन्द ललिफद्वाफने ककी प्रमक्रियद्वा अपिनद
