Heard Sri Geetam Singh, learned counsel for the petitioner and Sri Avinash Chandra Srivastava, learned counsel for the respondent. By means of this petition filed under Article 226 of the Constitution, petitioner has assailed the order dated 20th August, 2019, whereby her claim for family pension was rejected only on the ground that petitioner's husband was dismissed from service and a dismissed employee being not entitled to a pension, the dependent wife would also equally not entitled to family pension. Sri Srivastava has obtained instructions in the matter and placed before this Court, which is taken on record. As per the instructions order of dismissal from service passed against the husband of the petitioner has attained finality and hence benefit of pension was neither given to the husband of the petitioner, nor family pension can be given to the present petitioner.
