Heard learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the order of suspension dated 29.04.2025. Submission advanced by learned counsel for the petitioner is that since the petitioner's civil service examinations were due to be held, he applied for earned leave from 15.04.2025 to 24.05.2025 on 07.04.2025. Upon a pointed query being made, learned counsel for the petitioner could not demonstrate as to whether earned leave was sanctioned or not. In the given facts and circumstances of the case, since the petitioner proceeded on leave without getting the earned leave sanctioned, prima facie it amounts to misconduct and hence I decline to grant indulgence in the matter of suspension order dated 29.04.2025 at this stage.
